Eligibility to get arrears if the service is continuous as per employer's view



I am working in a state govt. aided university. Some persons filed a case for illegality of my appointment and high court terminated my job. Later I fought legally and got back my job in trial court. The appellant filed in division bench but later withdrew it. I was out of my service for nearly 34 months without pay. Now the university re-insteaded me giving my salary counting the above 34 months as uninterrupted service but reluctant to pay arrears for these 34 ,months when I was out of service. They pointed out that I did not work for the period and so not eligible to receive salary for this period.

My arguments are as follows:-
i) If the authority recognized my service as continuous and fixing salary accordingly, why am I not eligible to get arrears ?
