Consumer Law

Consumer Court is the special purpose court, mainly in India, that deals with cases regarding consumer disputes and grievances. These are judiciary set ups by the government to protect the consumer rights. Its main function is to maintain the fair practices by the sellers towards consumers. Consumers can file a case against a seller if they are harassed or exploited by sellers. The court will only give a verdict in favour of the consumers/customers if they have proof of exploitation, i.e., bills or other documents. If a consumer does not have the proper documents required for filing a case then it would be very difficult for the consumer to win or even file a case.

Consumer law is the group of laws that protect the public at large from unfair and predatory business practices. Consumer laws protect the public from immoral ways of doing business. The area of law requires compliance from the corporations that consumer laws regulate. The main regulatory provision is the Consumer Protection Act, 1986.

It makes provision for the establishment of consumer councils and other authorities to settle the disputes of consumers and matters connected therewith. It grants to consumers the right to be protected against the marketing of goods and services which are hazardous to life and property, the right to be informed about the quality and price of goods as the case may be, the right to be assured access to a variety of goods and services at competitive prices, the right to be heard and to be assured that their interest will receive consideration, the right to seek redressal against unfair practices, the right to choose and the right to consumer education.

The three forums established for redress all are- district forum, state commission and national commission. A District Forum is established by the State Government in each district of the State.

The State Government may establish more than one District Forum in a district. It is a district level court that deals with cases valuing up to Rs.20 lakhs. If a consumer is dissatisfied with the verdict of the district forum, they can approach the State Commission. It is a state level court that takes up cases valuing more than 20 lakhs,  but less than 1 crore million.

The National Commission is established by the Central Government. The forum deals with matters of more than 1 crore. It is the final appellate consumer authority. If the consumer is still dissatisfied with the verdict, they must approach the Supreme Court.
