Domestic Violence

The Protection of Women from Domestic Violence Act 2005 is the main law which protects women from domestic violence. It is a civil law meant primarily for protection, not criminal penalisation. For the first time in Indian law, a definition was coined for the term “domestic violence".

Domestic violence law is primarily meant to provide protection to women who may be married or in a live-in relationship with a male partner. The law also extends its protection to women living in a household with other relatives such as brothers, uncles or in-laws. Much progress has been made in the field of domestic violence law.

Domestic violence, under the Act, includes-
1. harms or injures or endangers the health, safety, life, limb or well-being, whether mental or physical, of the aggrieved person or tends to do so and includes causing physical abuse, sexual abuse, verbal and emotional abuse and economic abuse; or
2. harasses, harms, injures or endangers the aggrieved person with a view to coerce her or any other person related to her to meet any unlawful demand for any dowry or other property or valuable security; or
3. has the effect of threatening the aggrieved person or any person related to her by any conduct mentioned in clause (a) or clause (b); or
4. otherwise injures or causes harm, whether physical or mental, to the aggrieved person.
